By accessing or using our website at www.firelinefuel.com (the “Site”) or purchasing any products from us, you acknowledge that you have read, understood, and agree to be bound by these Terms. If you do not agree to these Terms, you must not use the Site or purchase our products.

Honey should not be consumed by children under one year of age.

Pricing

Prices are subject to change without notice. All prices are listed in U.S. dollars. We reserve the right to change prices at any time without prior notice. In the event of a pricing error, we reserve the right to cancel any orders placed at the incorrect price. Shipping costs are calculated at checkout and are non-refundable.

Intellectual Property

All content on the Site, including but not limited to text, graphics, logos, images, product designs, packaging, trade names (“Fireline Fuel,” “Hotshot Honey”), and software, is the property of Fireline Fuel LLC or its licensors and is protected by United States and international copyright, trademark, and other intellectual property laws. Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, FIRELINE FUEL LLC AND ITS MEMBERS, OFFICERS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, RESULTING FROM (A) YOUR ACCESS TO OR USE OF OR INABILITY TO ACCESS OR USE THE SITE; (B) ANY CONDUCT OR CONTENT OF ANY THIRD PARTY ON THE SITE; (C) THE USE OR CONSUMPTION OF ANY PRODUCTS PURCHASED THROUGH THE SITE; OR (D) UNAUTHORIZED ACCESS, USE, OR ALTERATION OF YOUR TRANSMISSIONS OR CONTENT. IN NO EVENT SHALL OUR TOTAL LIABILITY TO YOU FOR ALL CLAIMS ARISING OUT OF OR RELATING TO THESE TERMS OR YOUR USE OF THE SITE OR PRODUCTS EXCEED THE AMOUNT YOU PAID TO US IN THE TWELVE (12) MONTHS PRECEDING THE EVENT GIVING RISE TO THE LIABILITY.

OUR PRODUCTS ARE FOOD ITEMS INTENDED FOR GENERAL NUTRITION AND ARE NOT INTENDED TO DIAGNOSE, TREAT, CURE, OR PREVENT ANY DISEASE.

Indemnification

Dispute Resolution

These Terms shall be governed by and construed in accordance with the laws of the State of California, without regard to its conflict of law principles. Any dispute, claim, or controversy arising out of or relating to these Terms or the breach, termination, enforcement, interpretation, or validity thereof, including the determination of the scope or applicability of this agreement to arbitrate, shall first be subject to good-faith negotiation between the parties for a period of thirty (30) days. If the dispute cannot be resolved through negotiation, it shall be resolved by binding arbitration administered by JAMS in Humboldt County, California, in accordance with its Streamlined Arbitration Rules. The arbitrator’s decision shall be final and binding. YOU AGREE THAT ANY DISPUTE RESOLUTION PROCEEDINGS WILL BE CONDUCTED ONLY ON AN INDIVIDUAL BASIS AND NOT IN A CLASS, CONSOLIDATED, OR REPRESENTATIVE ACTION.

Changes to Terms

We reserve the right to update these Terms at any time. Continued use of the site means you accept the updated Terms.

Severability

If any provision of these Terms is held to be unenforceable or invalid, such provision will be changed and interpreted to accomplish the objectives of such provision to the greatest extent possible under applicable law, and the remaining provisions will continue in full force and effect.
